Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and BeachSports, LLC (“BeachSports,” “we,” “us,” or “our”), a California limited liability company. By creating an account, registering a child, or otherwise using this platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.

You must be at least 18 years old and the parent or legal guardian of the child you are registering — or otherwise legally authorized to register that child and to agree to these Terms and the waivers on the child’s behalf. Camps have age ranges; a child must meet the age requirement for a session as of the session’s first day.

You sign in with Google or with a one-time code we email you. You are responsible for keeping access to your email and account secure, for the accuracy of the information you provide, and for activity under your account. You also set a 4-digit pickup PIN used to authorize who may collect your child; keep it confidential and share it only with people you authorize to pick up your child.

Registration is complete only when payment is submitted and, where required, the medical information and waivers are completed. Spots are limited and are confirmed on a first-come, first-served basis when checkout completes — adding a session to your cart does not reserve a spot. If a session fills before you complete checkout, we will let you know and, where offered, may provide a waitlist or alternatives.

You agree to provide accurate, current, and complete information for each child, and to update it if it changes before or during a camp.

Prices are shown at checkout in U.S. dollars. Depending on the session, you may pay in full or pay a deposit now with the balance due later.

• Deposit and balance. If you choose to pay a deposit, you authorize BeachSports to securely save your payment method and to automatically charge the remaining balance to that method on the balance due date shown at checkout, without further action by you.
• Failed charges. If an automatic charge fails, we may retry it and will contact you. You remain responsible for the full amount due for a confirmed registration.
• Add-ons and changes. Optional add-ons are charged with your order. If you transfer to a more expensive session, the difference is added to your balance; if you transfer to a less expensive one, any refund follows the section below.

Payments are processed by Stripe; your card details are handled by Stripe, not stored by us.

Cancellations and refunds are governed by our published refund policy, which applies automatically based on how far in advance of the session you cancel. In general:

• Cancellations further in advance receive a larger refund; cancellations close to the start date receive a smaller refund, account credit, or no refund.
• A processing fee and a non-refundable registration fee may be deducted from any refund, as stated in the refund policy in effect when you registered.
• Transfers to another session or location are subject to availability; price differences are settled as described under Payments.

To cancel or transfer, contact us at register@beachsports.com. The refund policy in effect at the time of your registration controls, and our determination of the applicable tier is final.

You are responsible for accurately disclosing your child’s allergies, medical conditions, and any information needed to keep your child safe, and for keeping it current. If your child has a severe allergy and you indicate an EpiPen will be provided, you agree to supply it and to complete the related authorization so our staff can respond in an emergency. You authorize BeachSports staff to obtain or provide emergency medical care for your child if you cannot be reached and it is reasonably necessary. BeachSports is not a medical provider, and camp staff are not a substitute for professional medical care.

Beach and ocean sports involve inherent risks, including physical activity, sun and heat, water and surf conditions, and contact with others. As part of registration you will review and electronically sign one or more agreements — such as a liability waiver and, where applicable, an EpiPen custody authorization. Those signed documents are binding and their specific terms control on the matters they cover. By signing electronically, you agree your typed signature is your legal signature and consent to transact electronically. You may request a copy of any document you signed.

We want every camper to be safe and to have fun. You agree that your child will follow the reasonable instructions of BeachSports staff. We may remove a participant from a camp, without refund, for behavior that endangers the safety of the participant or others or that substantially disrupts a program.

BeachSports may photograph or film camp activities. During registration you choose whether we may use images of your child; we honor that choice, and you can change it by contacting us. Where you consent, you grant BeachSports permission to use those images to operate and promote our camps.

Occasionally we may need to change a session’s schedule, location, staff, or capacity, or cancel a session — for example due to weather, ocean or safety conditions, low enrollment, or circumstances beyond our control. If we cancel a session and cannot offer a reasonable alternative, we will provide a refund or credit for that session. We are not responsible for incidental costs (such as travel) related to a change or cancellation.

The BeachSports name, logo, this platform, and its content are owned by BeachSports or its licensors and are protected by law. You may use the platform only to register for and manage your family’s camps. You may not copy, resell, reverse-engineer, or misuse it.

The platform is provided “as is” and “as available.” To the fullest extent permitted by law, BeachSports disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted or error-free. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.

To the fullest extent permitted by law, BeachSports and its owners, managers, members, employees, contractors, instructors, licensors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of the platform. Our total liability for any claim relating to the platform will not exceed the amount you paid to us for the registration giving rise to the claim. This section does not affect the separate liability waiver you sign for camp participation, nor does it limit liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless BeachSports and the parties listed above from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the platform, or inaccurate information you provide, to the extent permitted by law.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree that any dispute relating to these Terms or the platform will be resolved in the state or federal courts located in California, and you consent to their jurisdiction — except where applicable law gives you the right to bring a claim elsewhere. If any provision of these Terms is unenforceable, the rest remain in effect.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the platform after an update means you accept the revised Terms.
